Terms of website use.

(Full terms and conditions will be given on booking of first lesson. with no obligation to book until you have read, signed

and returned the terms and conditions.)


1, Website owner, the offering, and binding of terms.
This website is owned and operated by Mr Stuart Richards. 
These terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors information about S.T.U. Driver education’s services. Also our contact information for the booking of/enquiring of services.
S.T.U. Driver education operates in the U.K. only and is governed by U.K. law.
By accessing or using the website of our service ,you approve that you have read, understood, and agree to be bound by these terms.

Please also tick the consent box on the contact form if you agree to these terms.


2, Who can use our services?
In order to use/receive our services, you must be at least 17 years of age, 16 if you are eligible to drive through the mobility scheme.

You must be the holder of a U.K. drivers licence-provisional/full. A valid international drivers licence. Not disqualified from driving. (licence checks in place.)

 You must possess the legal authority, right and freedom to enter into these terms ,according to U.K. law, as a binding agreement.
You are not allowed to use and/or receive services if it is prohibited by U.K. law or under any law or regulation applicable to you. You may need consent from a parent/guardian if you are under 18 years of age. This may apply to payment.

3, Privacy policy.

4, Provision of training.

Training will be provided to the client by S.T.U. Driver education, in return for payment.

We will agree a time, place and date for training to take place. This will be before the lesson.

We will usually use the training school vehicle. If training is to take place in the clients vehicle it is at the trainers discretion. The vehicle must be roadworthy, clean, at meet the DVSA's minimum standard for vehicles taken to test. gov.uk/driving-test/using-your-own-car

You must be able to read a standard number plate from a distance of 20 metres. with corrective lenses if you usually need them.

Fitness to drive; you must not be under the influence of drink or drugs. (including prescription drugs.)

We reserve the right to refuse training to clients whom we believe are not fit to drive.

The driver trainer is fully DVSA qualified. As such has signed the driver trainer's code of conduct DVSA and DIA.

The driver trainer will be polite, courteous, tidy and punctual*. *unless there are circumstances beyond their control.

5, Driving tests.

The trainer will notify the client when, in their opinion, they are ready for test. The trainer will reserve the right refuse the use of the school vehicle for test if they feel the client is not ready.

Booking the test. The client will book the test with the trainer's guidance of trainer's availability.

 If the trainer is booking the test on behalf of the client, the relative data and fees will be passed on to the trainer in advance.

The trainer will aim, to the best of their ability, to provide the training car for test, at the agreed fee.

If the training vehicle is unavailable to matters out of the control of S.T.U. Driver education hands, no liability will be placed on the school.

We will aim to give at least 3 days notice of any such lack of availability.

6, The school vehicle will be fitted with dual controls, extra interior mirror, dash cam equipment (for safety and training purposes) The dashcam does not record sound or images inside the vehicle, if this is required for training, written consent from the client will be sought with no obligation.


7, Ownership of intellectual property, copyrights and logos.
The service and all materials therein or transferred thereby, including,without limitation,software, images,text,graphics,logos,patents,trademarks,service marks,copyrights, photographs, audio,video, quizzes,and all intellectual property rights related thereto are the exclusive property of Mr Stuart Richards.
Nothing in these terms shall be deemed to create a licence in or under any such intellectual property rights, and you agree not to sell,licence,rent,modify,distribute,copy,reproduce,transmit,publicly display,publicly perform, publish,adapt,edit or create derivative works thereof.

8,At present we do not allow advertising, other than our own, on the site. We do not endorse any products, We do not receive payment for any product placement. Naming of vehicles is done in courtesy to the manufacturer.

9, Payment.

The hourly rate is £40.

We aim to give one calendar month notice of any price increase.

We do not make any transactions on the website. Cash payment is taken on the day of the lesson in car.

Due to the covid-19 crisis, we do urge you to consider payment via bank transfer. We will give you bank details prior to your first lesson. Payments by bank transfer will be in advance of the lesson. a receipt, via email, post if you prefer, will be sent. 

Block bookings, will be accepted. Discounts may be offered on block bookings of 10 hours and over, contact us for details. We will notify you as to how many lessons have been taken and how many remain.

 

10, Refunds.

If you/we terminate training with us. We will refund monies owed for lessons not taken.

No refund will be offered for circumstances beyond our control, listed below.

11, Cancellations.

If you cancel your lesson without 24 hours prior notice it will incur a fee of £20.

Fleet training cancellations. Notice of 5 working days must be given if the training is to be cancelled. A fee of £50 is payable if the training is an assessment of four hours or less. Training courses of four hours or more incur a fee of £100 if cancelled within this period. 

Your lesson/ assessment will be terminated if we believe you are under the influence of drink or drugs. drugs will also include prescription/over the counter drugs that may effect your ability to drive safely.

A late cancellation fee of £20, from you, will apply.

Eyesight checks will be carried out in accordance with the highway code.

We may need to cancel at short notice. If this is the case we will try to give at least 24 hours notice, 5 working days for fleet training.

An alternative date will/may be offered. On cancellation, a late cancellation fee of £20 will be offered*. (learners.)

If you have pre-paid for the lesson, we will refund that payment or carry it on to the next lesson. (learners)

A refund of £50 for Fleet if assessment is less than 4 hrs. over 4 hour course, refund of course fee.

*Unfortunately there may be circumstances beyond our control. ie: illness, legal obligation to cease training (ie: pandemic), vehicle failure, incident during travelling to and from appointments. If these occur no refund will be offered, We will try to arrange an alternative date for training.


12, Termination of training.
We may permanently or temporarily terminate or suspend your access to the service if we suffer verbal/physical abuse, slanderous activity. You deliberately mis-use/damage the vehicle. Fail to pay monies owed on a regular basis. 

Attend training in an unfit state to drive.
You may discontinue use and request to cancel any services at any time. If this is the case, please refer to our refund policy and 11.

The user is solely responsible for driving safety and legal responsibility.

Training is offered as guidance. Training will be governed by DVSA. We will adhere to our governing bodies guidelines for training.

 


13, Limitation of liability 
Nothing in this agreement will limit S.T.U. Driver education's liability in any for death or personal injury caused by the schools negligence.

The client's failure to comply with obligations,under this agreement or terms and conditions or the trainer's reasonable instructions will render S.T.U. Driver training not liable , under any circumstances.

The aggregate liability of S.T.U. Driver training for direct loss resulting in the schools default will be limited to £50 per claim.

S.T.U. Driver education will not be liable for the losses, costs, claims, or expenses arising as a result of any event which is out of the schools reasonable control or expectation.

S.T.U. Driver education will not be liable, whether based on contract or tort, or any other legal or ground for any consequential, indirect or incidental loss of whatever kind or however caused.


14, Right to change and modify terms.
We reserve the right to modify these terms from time to time at our sole discretion.
Therefore, you should review these pages periodically. When we change the Terms in a material manner we will notify you that material changes have been made to the Terms.
Your continued use of the website or our services after any such change constitutes your acceptance of the new Terms.
If you do not agree to any of these terms or any future version of the terms , do not use or access (or continue to access) the website or the services.

15, Complaints.

16, Promotional emails and content.
If you would like to receive promotional messages and materials from, by mail,email or any other contact form you may provide us with (including your phone number for calls and text messages) please contact with your consent.
